SALE CONDITIONS
The current general conditions regulate the sale of the products commercialized by BETOBE TIME. All the sale contracts regarding the products sold by BETOBE TIME to third parties are regulated by these current general conditions, which form an integrating and substantial party of any proposal, order and order confirmation of the products themselves. The sale conditions which apply to your order are those which are in force at the time of the order itself.
1. PRODUCTS, PRICES AND CHARACTERISTICS
1.1 The prices of the products indicated by BETOBE TIME must be meant tax (IVA) excluded. The current prices of the products shown by BETOBE TIME cancel or replace the previous ones and they are subordinated by the real availability of the products themselves. BETOBE TIME reserves the right to confirm or modify the prices of the products shown on its internet site or on informative booklets and advertisement material at the moment of the confirmation of the order itself.
1.2 The technical and functional characteristics regarding the products shown by BETOBE TIME through its own promotional advertisements and informative booklets are those indicated by the manufacturers of the products themselves. BETOBE TIME doesn’t take any responsibility of the truthfulness and of the completeness of such information. Except where differently indicated. The images of the products are not indicative and not binding.
1.3 The customer is responsible for the choice of the products ordered and for the correspondence and conformity of the specifications indicated by each manufacturer to his/her own needs.
1.4 Products are provided with boxes and warranty.
2. ORDERS – BILLING
2.1 All the purchase orders sent to BETOBE TIME must be complete in all their parts and they must be filled in with all the necessary data to correctly single out the products ordered. Each order sent to BETOBE TIME forms a contractual proposal of the customer and so BETOBE TIME will be bound to it only if the order is confirmed and accepted. The execution of the order by BETOBE TIME means the confirmation and the acceptance of the order itself.
2.2 BETOBE TIME reserves the right to not accept incomplete orders, either not fully filled in or with a total amount inferior to the minimum value of 100,00 euros (excluding shipping costs). When BETOBE TIME doesn’t carry out an order (in case of unavailability of the products ordered by the customer), BETOBE TIME will provide to inform the customer about it as soon as possible, refunding the amount of money that the customer eventually already paid following the non delivery of the products. In this case the customer won’t be entitled to any further refund, indemnity or compensation for damages and, furthermore, all the prices regarding a purchase of products shown on www.orologistock.com are effective only on that kind of transaction and not on retail sales or on sales from catalogs.
2.3 The fiscal documents (receipt or invoice) regarding the products ordered will be issued by BETOBE TIME at the moment of the dispatch of the products themselves to the customer.
3. WAY OF PAYMENT
3.1 Our way of payment are Bank Transfer and Credit Card “commission 4,0%”.
4. DELIVERY OF THE PRODUCTS – DELIVERY TIME
4.1 The delivery time is 24 maximum 48 hours without the notice of BETOBE TIME and depend on the payment. With Bank Transfer payment the shipping time could become longer than the usual time.
4.2 All the delivery costs will be covered by the customer (excepto promociones). The deliveries are normally effected by DHL carrier. All the on-line transactions follow the payment in advance method.
BETOBE TIME reserves to accept cash on delivery. BETOBE TIME has the right, behind its own unquestionable judgment, to effect the delivery by a different carrier from DHL or by other means of transportation which is considered appropriate. All the deliveries are effected on the roadway, except where differently indicated.
4.3 The terms of delivery indicated by BETOBE TIME refer to the products stocked in its own warehouses and, even if they are estimated with attention, they have to be meant not binding on BETOBE TIME, which can later confirm or modify them following its own real requirements. Possible shipping delays of less than 30 (thirty) days don’t entitle the customer to refuse the delivery of the products or to claim refunds or indemnities.
4.4 BETOBE TIME has the right to effect the delivery of the products (also related to one sole order) in different times: in this case it will charge the customer only once with the shipping costs.
4.5 Special conditions and terms of delivery must be previously arranged between the customer and BETOBE TIME and then accepted in writing by BETOBE TIME.
5. SHIPPING COST – ORDER EXPEDITION
5.1 The shipping cost depend on the geographic area and on the weight and are calculated in the invoice at the end of the order.
5.2 The minimum order is € 100,00.
6. SPECIAL OFFERS – PROMOTIONAL CODE
6.1 The possible special offers promoted by www.orologistock.com are effective till depleted supplies and, in any case, they are subject to the real availability of the related products. The special offers promoted can’t be accumulated. The products of the special offers might be inside a promotional packing (where packing means boxes, manuals etc).
6.2 The promotional code is only for Italy and Italian clients.
7. WARRANTIES ON THE PRODUCTS – TECHNICAL ASSISTANCE
7.1 BETOBE TIME only guarantees the material integrity of the products at the moment of the delivery (next, the “BETOBE TIME Warranty”). Possible defects covered by the BETOBE TIME Warranty must be reported by the customer not later than 10 (ten) days from the date of delivery. In case the BETOBE TIME Warranty can be applied, the customer has the right to have his damaged products replaced after returning them, excluding any right for a compensation for further damages. The necessary shipping costs to replace the items are covered by BETOBE TIME.
7.2 Taking for granted everything on point 5.1, BETOBE TIME doesn’t offer any further warranty than that given by the single manufacturers of the products commercialized. The technical assistance and all the repairs of the products covered by the warranty, when provided, are taken care of by the single manufacturers, following the terms and the forms reported on the papers attached to the products themselves.
7.3 Except for the supposition of fraud or of an important guilt of BETOBE TIME, it’s from now settled that, if it is recognized the responsibility of BETOBE TIME towards any claim of the customer - including the partial or full non-execution of the obligations assumed by BETOBE TIME towards the customer regarding the execution of an order – the responsibility of BETOBE TIME can’t be higher than the price of the products purchased by the customer and about which a contestation was raised.
7.4 RETURN OF THE ITEMS TO THE CUSTOMER: the customer will be contacted by BETOBE TIME as soon as the items are looked over.

9. COMPETENT COURT
Taking for granted the possible applicability of intransgressible provisions of the law to protect the consumers (like they are defined according to the article 1, letter B, of the Legislative Ordinance number 185 of the 22nd of May 1999), any controversy associated to the current General Conditions will be transferred to the sole competence of the Milan Court. According to and following the effects of the articles 1341 and 1342 of the Civil Law, the customer states to have read with attention and understood and to specifically accept the following clauses of the General Conditions of Sale: 1.1, 1.2, 2.1, 2.2, 3.2, 4.1, 5.1, 5.2, 5.3, 6.2, 6.3, 6.4, 6.5 and 7.

11. WITHDRAWAL
11.1 According to the article 5 of the Legislative Ordinance number 185 of the 22nd of May 1999, the customer (when he/she can be recognized as “consumer” according to the article 5, letter B, of the Legislative Ordinance number 185 of the 22nd of May 1999) has the right to withdraw from the contract and to send back the products ordered, with no penalty and without specifying the reasons, not later than 10 (ten) working days from the receiving date of the products themselves.
11.2 The right to withdraw from the order explained at the point 6.1 will have to be exercised by the customer by sending a registered letter with return receipt to BETOBE TIME, via Tucidide 56, 20134 Milano, Italy, not later than 10 (ten) working days from the receiving date of the products. Not doing so would lead to the forfeiture of the right.
The communication of here above can also be sent to BETOBE TIME, always within the same times, by telegram, email to info@orologistock.com or fax at the number 0226693429, as long as confirmed by a registered letter with return receipt within the following 48 (forty-eight) hours from sending the telegram or the fax.
11.3 All the returned items (which will have to be perfectly undamaged and in their original packing) must be allowed by the BETOBE TIME Customer Service, which will release a number of authorization for the return (RMA). After receiving the RMA, the customer will be allowed to return the product back to: BETOBE TIME, via Tucidide 56, 20134 Milano, Italy. Packages shipped back using the cash on delivery method won’t be accepted.
11.4 After receiving the returned packages (and verified their integrity), BETOBE TIME will provide to credit the customer with the cost of the returned items (as indicated on the invoice) in the shortest amount of time possible deducting, when necessary, the shipping costs which will definitely be covered by the customer.
11.5 The right to withdraw from the order indicated at the point 6.1 can’t be exercised by the customer when the products were opened by the customer himself/herself.
12. R.M.A
